Terms of Service

1. Acceptance of Terms

By accessing or using Uptime Assure ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Description of Service

Uptime Assure is an uptime monitoring platform that performs automated HTTP/HTTPS checks on URLs you configure, tracks SSL certificate expiry, measures response times, and delivers alerts via Email and Slack.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and current information during registration.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at support@uptimeassure.in if you suspect unauthorised access.

4. Acceptable Use

You agree not to use Uptime Assure to:

  • Monitor URLs or services that you do not own or have explicit permission to monitor.
  • Use the platform to conduct denial-of-service attacks or stress tests against third parties.
  • Circumvent rate limits, access other users' data, or reverse-engineer the platform.
  • Submit false, misleading, or unlawful content via alert configurations.

Violation of acceptable use may result in immediate account suspension without refund.

5. Plans, Payments & Refunds

Uptime Assure offers a Free plan and paid plans (Basic, Pro, Enterprise) billed monthly or yearly in INR. Payments are processed by Razorpay.

  • Paid subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel at any time; access continues until the end of the current billing period.
  • Refunds are considered on a case-by-case basis for unused annual subscriptions. Contact us within 7 days of payment.
  • We reserve the right to change pricing with 30 days' advance notice to existing subscribers.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure issues, or third-party outages may temporarily affect monitoring. We are not liable for any damages caused by service downtime.

Monitor check intervals are best-effort. Actual check frequency may vary slightly due to system load.

7. Data Ownership

You retain full ownership of the URLs, configurations, and data you add to Uptime Assure. By using the Service, you grant us a limited licence to store and process that data solely for the purpose of providing the Service.

8. Termination

You may delete your account at any time from Settings. We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity. Upon termination, your data will be deleted within 30 days.

9. Limitation of Liability

To the maximum extent permitted by law, Uptime Assure shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to missed alerts, inaccurate check results, or data loss.

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or dashboard notice at least 14 days before they take effect. Continued use after changes constitutes acceptance of the revised Terms.
